This Refund & Cancellation Policy applies to services provided by KINBRIDGE CONSULTING PRIVATE LIMITED, operating under the brand name KINBRIDGE IMMIGRATION ("KINBRIDGE", "we", "us", or "our").
The refund and cancellation terms applicable to a particular immigration or consultancy service may differ depending on the nature of the service.
Where a separate written service agreement, engagement letter or proposal has been signed by the client, the specific terms of that document will govern the relevant service.
1. General Principle
KINBRIDGE aims to provide clear information regarding:
- Scope of service
- Professional fees
- Payment schedule
- Government and third-party charges
- Services included
- Services excluded
- Cancellation terms
- Refund conditions
These details will be communicated to the client before commencement of the relevant professional engagement wherever reasonably possible.
2. Website Enquiries
Submitting an enquiry through the KINBRIDGE website does not create an obligation to purchase any service.
A website enquiry may be cancelled at any time before a paid service has been formally accepted and commenced.
3. Consultation Fees
Where a paid consultation has been booked, the applicable consultation cancellation and refund terms will be communicated at the time of booking.
If the consultation has already taken place, the consultation fee will generally not be refundable unless otherwise agreed or required under applicable law.
4. Professional Service Fees
Refund eligibility for professional service fees depends on:
- The nature of the service
- Work already completed
- The applicable service agreement
- The reason for cancellation
- Any specific refund conditions agreed with the client
A client should therefore refer to the relevant service agreement before requesting cancellation.
5. Cancellation by the Client
A client may request cancellation of a service by contacting KINBRIDGE in writing.
Where work has already commenced, any refund will be determined according to the applicable service agreement and the work already undertaken.
Cancellation by a client does not automatically create an entitlement to a full refund.
6. Cancellation Before Commencement
Where a client cancels before KINBRIDGE has commenced substantive work, the applicable service agreement will determine whether a refund is available.
Any non-refundable administrative or third-party charges already incurred may be deducted where applicable and legally permissible.
7. Cancellation After Work Has Commenced
Where KINBRIDGE has already undertaken work on behalf of the client, including profile assessment, documentation review, application preparation, submission assistance, correspondence or other agreed services, the refund position will be determined by the applicable service agreement.
Fees relating to work already completed may not be refundable where permitted under the applicable agreement and law.
8. Government and Third-Party Fees
Fees paid to third parties, including:
- Government authorities
- Immigration departments
- Embassies or consulates
- Skills assessment authorities
- Language-testing organisations
- Medical providers
- Translation providers
- Courier companies
- Other third-party service providers
are generally subject to the refund policies of those third parties.
KINBRIDGE cannot guarantee a refund of a third-party fee where the relevant authority or provider does not permit a refund.
9. Visa or Immigration Refusal
A visa, nomination, permanent residency, skills assessment or other immigration application may be refused by the relevant authority.
Unless a specific refund condition has been expressly included in the applicable service agreement, an immigration refusal does not automatically create an entitlement to a refund of KINBRIDGE's professional fees.
The final decision rests with the relevant authority and is outside KINBRIDGE's control.
10. Refunds Specifically Promised Under a Service Agreement
Certain KINBRIDGE services may contain specific refund conditions.
For example, a service agreement may specify a refund linked to a particular stage, assessment outcome or failure by KINBRIDGE to perform an expressly agreed service.
Where such a condition exists, the signed service agreement will specify:
- The event triggering the refund
- The portion of the fee refundable
- Any exclusions
- Required supporting documents
- The procedure for requesting the refund
- The expected processing period
Such specific terms will apply to that particular engagement.
11. Client Withdrawal
If a client voluntarily withdraws from an ongoing engagement, the refund position will depend on the applicable service agreement.
Where work has already been completed or third-party expenses have been incurred, the corresponding amounts may be non-refundable subject to the applicable agreement and law.
12. Delays Caused by the Client
KINBRIDGE may not be responsible for delays or additional work caused by:
- Failure to provide requested documents
- Delayed responses
- Incomplete information
- Incorrect information
- Failure to attend appointments
- Failure to meet agreed deadlines
- Failure to comply with authority requirements
Any resulting consequences will be dealt with according to the applicable service agreement.
13. Changes in Government Rules
Immigration programmes may change, be suspended, amended or closed by the relevant authority.
Where a programme changes after an engagement has commenced, KINBRIDGE will assess the situation and communicate available options within the scope of the applicable engagement.
A change in government policy does not automatically create a refund entitlement unless specifically provided for in the applicable service agreement.
14. Refund Request Procedure
A refund request should be submitted in writing to KINBRIDGE and should include:
- Client's full name
- Invoice or engagement reference
- Relevant service
- Date of payment
- Reason for refund request
- Supporting documents, where applicable
KINBRIDGE may request additional information where necessary to assess the request.
15. Refund Processing
Where a refund is approved, it will generally be processed using the payment method originally used by the client, where reasonably possible.
The applicable refund processing period will depend on the circumstances and the relevant service agreement.
Third-party processing times may also affect when the refund is received.
16. No Double Recovery
Where a third-party authority separately provides a refund to the client, the same amount will not ordinarily be refundable again by KINBRIDGE.
Any applicable refund will be calculated in accordance with the relevant service agreement.
17. Disputes Regarding Refunds
If a client disagrees with a refund decision, the client may contact KINBRIDGE in writing with the relevant details and supporting information.
KINBRIDGE will review the matter in accordance with the applicable service agreement and applicable law.
18. Changes to this Policy
KINBRIDGE may update this Refund & Cancellation Policy from time to time.
The latest version will be published on this page with the revised "Last Updated" date.
Changes to this general website policy will not override a specific refund provision contained in an already signed service agreement unless legally required.
